Terms of Service

Welcome to DNA BROWS. These Terms of Service (the “Terms”) govern your access to and use of https://dnabrows.com, our online store, and the content, features, products, and services made available through them (collectively, the “Services”).

The Services are operated by DNA BRANDS LLC, doing business as DNA BROWS (“DNA BROWS,” “we,” “us,” or “our”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

Please read these Terms carefully. By visiting, browsing, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least the age of majority in your state or place of residence to make a purchase. If you permit a minor to use the Services, you are responsible for that use and for supervising the minor.

You agree to provide accurate, current, and complete account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Notify us promptly if you believe your account has been accessed without authorization.

We may refuse service, suspend access, or cancel an account when reasonably necessary to protect the Services, our customers, or our rights; prevent fraud or abuse; or comply with law.

2. Product information and availability

We make reasonable efforts to describe and display our products accurately. Product colors, packaging, engraving, botanical patterns, materials, dimensions, and appearance may vary slightly from photographs because of screen settings, lighting, natural-material variation, manufacturing updates, or packaging changes. Natural bamboo components may vary in grain, tone, and engraved pattern.

Product descriptions, ingredients, packaging, prices, and availability may change without notice. We may discontinue products or limit quantities by customer, household, order, region, or jurisdiction. All products are subject to availability, and placing an item in a cart does not reserve it.

3. Cosmetic product use and results

Our brow oils and other cosmetic products are intended for cosmetic use and external use only. Follow the directions and warnings provided with each product. Avoid direct contact with the eyes. Review the ingredient list before use, do not use a product if you know you are allergic or sensitive to an ingredient, and consider performing a patch test before first use. Stop use and seek appropriate medical advice if irritation or another adverse reaction occurs.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition and are not a substitute for medical advice or treatment. Product experiences and cosmetic results vary from person to person. We do not guarantee hair growth, faster growth, regrowth, or any specific result. References to nourishing, conditioning, reduced breakage, retention, or fuller-looking brows describe intended cosmetic appearance or care benefits, not guaranteed biological or medical outcomes.

If you are pregnant, nursing, under medical care, have a skin or eye condition, or have questions about whether a product is appropriate for you, consult a qualified healthcare professional before use.

4. Orders and acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment problems, shipping restrictions, or violations of these Terms.

If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion. We will use the contact information supplied with the order to notify you when reasonably possible.

Please review your order before submitting it. Once fulfillment begins, we may be unable to change or cancel it. Products are offered for personal or household use unless we expressly approve resale or wholesale purchasing in writing.

5. Prices, taxes, and payment

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. The price charged is the price displayed at checkout when the order is submitted, subject to correction of obvious errors. Shipping, handling, taxes, duties, customs charges, and other fees may be added where applicable and will be displayed or assessed as required.

You represent that you are authorized to use the payment method submitted and that the information provided is accurate. Payment processing may be performed by Shopify or other third-party providers under their own terms and privacy practices.

6. Promotions, discount codes, and free gifts

Promotions, discount codes, launch offers, free gifts, and samples are subject to their stated terms, eligibility rules, dates, inventory, and exclusions. Unless expressly stated otherwise:

  • offers have no cash value and cannot be exchanged for cash;

  • only one promotional code may be used per order;

  • offers cannot be combined;

  • a free gift must be added to the cart when instructed;

  • free gifts and samples are available only while supplies last; and

  • customer, order, product, and redemption limits may apply.

We may modify, suspend, or cancel a promotion when permitted by law, including in cases of error, fraud, abuse, unauthorized distribution, or circumstances outside our reasonable control. If promotional terms conflict with these Terms, the specific promotional terms control for that promotion.

7. Shipping and delivery

Shipping and delivery dates are estimates, not guarantees. Delays may occur because of carrier operations, weather, customs, holidays, inventory issues, incorrect address information, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be your responsibility where permitted by law. Risk of loss and title transfer as provided by applicable law. If an order is lost, damaged, or marked delivered but cannot be located, contact us promptly so that we can review the matter and any available carrier claim.

8. Returns and refunds

Returns, exchanges, damaged products, missing items, and refunds are governed by our Refund Policy, which is incorporated into these Terms. Nothing in these Terms limits non-waivable consumer rights provided by applicable law.

9. Privacy and electronic communications

Our collection and use of personal information are described in our Privacy Policy. Because Shopify hosts our store, Shopify and service providers may process information to operate checkout, payments, fraud prevention, analytics, fulfillment, and other store functions.

When you provide an email address or phone number for an order, you consent to receiving transactional communications related to that order. Marketing emails or text messages are subject to separate consent and disclosure requirements. You may unsubscribe from marketing communications using the instructions included in those messages, though you may still receive non-marketing communications concerning purchases, security, or legal notices.

10. Intellectual property

The Services and their contents—including text, graphics, photographs, videos, product names, product designs, packaging, logos, artwork, engraving patterns, layout, and other materials—are owned by or licensed to DNA BROWS and are protected by applicable intellectual-property laws.

DNA BROWS, GROW CODE OIL, associated logos, packaging, designs, and slogans may constitute trademarks, trade dress, or other proprietary rights, whether registered or unregistered. Except for personal, noncommercial use of the Services, you may not copy, reproduce, modify, distribute, display, sell, license, scrape, republish, or create derivative works from our content without prior written permission.

No license or ownership interest is transferred to you except for the limited right to use the Services in accordance with these Terms.

11. Reviews, content, and influencer disclosures

If you submit a review, photograph, video, comment, testimonial, suggestion, or other content (“User Content”), you represent that it is truthful, based on your genuine experience, does not violate another person’s rights, and does not contain unlawful, deceptive, defamatory, obscene, or malicious material.

You retain ownership of your User Content. By submitting User Content directly to our Services or tagging or sending it to us with a request or clear indication that we may feature it, you grant DNA BROWS a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt for formatting, display, distribute, and use that content to operate and promote the Services, subject to applicable law. Where additional permission is legally required for advertising use, we will request it.

We may moderate or remove User Content, but we are not obligated to do so. We do not require positive reviews and do not condition incentives on the sentiment of a review.

If you receive a free product, discount, payment, commission, or another benefit from DNA BROWS and post about us, you must clearly and conspicuously disclose that material connection in accordance with applicable advertising rules and platform requirements. Any endorsement must reflect your honest experience.

12. Prohibited uses

You may not use the Services to:

  • violate any law, regulation, or third-party right;

  • engage in fraud, impersonation, harassment, abuse, or deceptive conduct;

  • submit false payment, account, review, or shipping information;

  • introduce malware, harmful code, or disruptive technology;

  • interfere with security, access controls, checkout, or normal operation;

  • collect personal information about others without authorization;

  • send spam or unauthorized promotions;

  • scrape, crawl, copy, or extract content or data through automated means except as expressly permitted by us or applicable law; or

  • resell, exploit, or misuse any part of the Services without authorization.

We may investigate suspected violations and cooperate with lawful requests from authorities.

13. Third-party services and links

The Services may include third-party tools, applications, payment services, social-media features, or links. We do not control and are not responsible for third-party services, content, security, availability, or practices. Your use of third-party services is governed by the third party’s terms and policies. Review those terms before using the service or completing a transaction.

14. Shopify’s role

Shopify provides the ecommerce platform used to operate our store. Purchases made through the store are transactions directly between you and DNA BRANDS LLC, doing business as DNA BROWS. Shopify is not the seller of our products and is not responsible for product claims, fulfillment, customer service, or disputes between you and DNA BROWS, except to the extent required by applicable law or expressly provided under a separate Shopify service.

15. Errors and corrections

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning descriptions, prices, promotions, availability, shipping charges, or delivery estimates. We may correct or update information and, when reasonably necessary, cancel an affected order. If we cancel after charging you, we will issue an appropriate refund.

16. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT FOR ANY EXPRESS WARRANTY PROVIDED BY US, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THESE TERMS DO NOT EXCLUDE WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DNA BROWS AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO DNA BROWS FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING, WHERE APPLICABLE, LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DNA BROWS and its affiliates, owners, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, and reasonable legal costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.

We will provide reasonable notice of an indemnified claim and may control its defense and settlement. This section does not require a consumer to indemnify us for our own unlawful conduct, negligence, product defect, or breach.

19. Termination

You may stop using the Services at any time. We may suspend or terminate access when we reasonably believe you have violated these Terms, created risk or potential legal exposure, engaged in fraud or abuse, or when suspension is necessary to protect the Services or comply with law.

Termination does not affect obligations or rights that arose before termination. Provisions that by their nature should survive—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will survive.

20. Governing law

These Terms are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law principles. This choice of law does not deprive consumers of mandatory protections available under the laws of their place of residence.

Before filing a legal claim, you and DNA BROWS agree to make a good-faith attempt to resolve the issue by contacting the other party and providing a reasonable opportunity to respond. Nothing in this section prevents either party from seeking urgent injunctive relief or using an available small-claims process.

21. Severability, waiver, and assignment

If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the business, subject to applicable law.

22. Entire agreement

These Terms, together with policies and terms expressly incorporated by reference, constitute the entire agreement between you and DNA BROWS concerning the Services and supersede prior communications on the same subject. If a specific promotion or service has additional terms, those terms control for that promotion or service to the extent of a conflict.

23. Changes to these Terms

We may update these Terms to reflect changes to the Services, our practices, or applicable law. The updated version will be posted on this page with a revised effective date. When required by law, we will provide additional notice. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the changes, except where further consent is required by law.
